You may not incorporate any portion of the Saveitbig Platform into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the sublicense Saveitbig Platform or otherwise assign any rights to the Saveitbig Platform in whole or in part. DEBIT/ CREDIT CARD, BANK ACCOUNT DETAILS

(a)           You agree that the debit/ credit card details provided by you for use of the purchase of Services is correct and accurate and that you will not use a debit/ credit card, that is not lawfully owned by you or the use of which is not authorized by the lawful owner thereof. You further agree and undertake to provide correct and valid debit/credit card details.

(b)           You may pay for Services by using a debit/ credit card or through online banking account. Further, you warrant, agree and confirm that when you initiate a payment transaction and/ or issue an online payment instruction and provide your card/ bank details:

(i)            You are authorizing debit of the nominated card/ bank account for the payment of fees selected by you along with the applicable fees; and

(ii)          You are responsible to ensure sufficient credit is available on the nominated card/ bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by you inclusive of the applicable fee.

CLAIMS AGAINST OBJECTIONABLE CONTENT

Saveitbig lists millions of products offered for sale on the Website and hosts many thousands of comments, it is not possible for Us to be aware of the contents of each product listed for sale, or each comment or review that is displayed. Accordingly, the Website operates on a “notice and takedown” basis. If you believe that any content on the Website is illegal, offensive (including but not limited to material that is sexually explicit or which promotes racism, bigotry, hatred or physical harm), deceptive, misleading, abusive, indecent, harassing, blasphemous, defamatory, libellous, obscene, pornographic, paedophilic or menacing; ethnically objectionable, disparaging; or is otherwise injurious to third parties; or relates to or promotes money laundering or gambling; or is harmful to minors in any way; or impersonates another person; or threatens the unity, integrity, security or sovereignty of India or friendly relations with foreign states; or objectionable or otherwise unlawful in any manner whatsoever; or which consists of or contains software viruses, (“Objectionable Content“), please notify Us immediately Once notified, We will make all reasonable endeavours to remove such Objectionable Content complained about within a reasonable time.

PRICING

We aim to ensure that prices of all products are correct and up-to-date. However, from time to time, prices for certain products may not be current or may be inaccurate on account of technical issues, typographical errors or incorrect product information provided to Us by a supplier. In each such case, notwithstanding anything to the contrary, We reserve the right to cancel the order without any further liability. Subject to the foregoing, the price mentioned at the time of ordering a product shall be the price charged at the time of delivery, provided that no product listed on the Website will be sold at a price higher than its MRP (Maximum Retail Price).

DAMAGED AND DEFECTIVE GOODS

(a)           We will not be responsible for damaged or defective goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered unless the customer gives written or email notice of a claim to the company within 2 Business days.

(b)           In the event of damage of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered, you must hold the goods and make them available for inspection or collection by Us or Our representatives on request.

(c)           Our total liability under any warranty for defective or damaged goods supplied by us, or in relation to services is limited at Our option to either:

(i)            replacing the defective or damaged goods; or

(ii)          refunding the price of the defective or damaged goods.

(d)           We are not under any obligation to accept any returns of products where the defect or damage was caused by you or the defect or fault occurred after dispatch of Services.

Fine print

For the purpose of these Terms:

(a)           Damaged shall mean unforeseen and accidental physical loss, breakage, destruction of or damage to tangible property including the loss of use thereof at any time resulting from nuisance or interference with any right of way, light, air or water.

(b)           Defect shall mean an error, that prevents the required usage or which substantially diminishes the possibilities or use of the products with the following specifications:

(i)            a defect is substantial, if it cannot be cured despite repeated attempts such that the product cannot be used at all;

(ii)          it is not a defect, if buyer or a third party make modifications or repairs to the product without the company’s permission unless the buyer can prove that the defect occurred independently from the modification or repairs.

RETURNS

Returns at Saveitbig are easy and customer friendly. If the product is defective, damaged, wrong item sent, item missing or you no longer wish to keep the product, you need to follow the below mentioned guidelines and arrange for return pick-up within 2 Business days:

(a)           Return Pick-up

(i)            Make a call to Our customer service representative at +91 9601601466 and We shall arrange for the pickup within [2 business days].

(ii)          Kindly keep a copy of the invoice highlighting the items being returned.

(iii)        Return shipments are trackable. Refer to the tracking ID mentioned on the receipt at the time of return.

(iv)         Once We receive the product back, you will receive an email confirmation about the same. It usually takes 24-48 hours for Us to receive the item back.

(v)           If the return pick-up option is not available in your area or if you choose to return the item yourself. Include the required return documentation with your package. You can return the package using any courier/ postal service of your choice.

(vi)         If you wish to exchange the products, you must submit the following at the time of exchange:

·               Product Return Form

·               Reason for Return

·               Copy of Invoice

·               Copy of Customer Order Receipt

·               Products to be returned

The aforesaid documents are required to be submitted at the time of return pick-up.

(b)           Fine print

(i)            [Please note that the return shipping cost will be borne by you in case you wish to return the item for the reason “I no longer need / wish to keep the item”.]

(ii)          Certain items are non-returnable, an icon on the item description page would specify that the item can’t be returned.

(iii)        The product must be returned in the original condition they were received in with all the accompanying accessories.

(iv)         Replacement/ refund would only be initiated once the return is received and been inspected for defect/ damage.

(v)           Items that you no longer need must be returned in new and unopened condition with all the original packing, tags, inbox literature, warranty/ guarantee card, freebies and accessories.

REFUNDS

(a)           Once We receive the item/ shipment back at Saveitbig, We initiate the process of refund within 2 (two) business days.

(i)            Electronic payment (credit card, debit card or net banking) refunds are processed within [2-4 business days] whereby you will need to update following information to enable Us to process a refund to your account:

·               Bank Account Number

·               IFSC Code

·               Account Holder’s Name

·               Bank Branch

·               Bank Name

(ii)          Mixed Payment (credit card, gift cards or credit points) – The refund amount shall be paid through the same mode of payment. The gift card amount shall be added to your account under points and can be used for redemption towards future purchases.

(b)           Fine Print

(i)            Refunds to happen through the same mode by which the payment was made, however, you may want to request for a change to credit/reward points.

(ii)          If your refund doesn’t appear in ‘Your Account’, and the processing time for your payment method has passed, contact Us for further assistance.

(c)           Expired Payment Method

If the original payment method you used to make the payment (credit/ debit card) is no longer valid, We will issue the refund through a demand draft.

When We receive a payment failure notice from your bank, We will send you an e-mail asking you to call us. When you call Us back, We will collect your name and the address where you want the demand draft to be sent, and proceed with the refund.

(d)           No Cancellation or Refund on Gift Cards and Reward Points

Gift cards once purchased cannot be cancelled or returned due to regulatory issues. If you have an exceptional circumstance due to which you require a refund for a gift card, please contact us.

CANCELLATION POLICY

Non-Customer Cancellation:

Saveitbig reserves the right to cancel any order if –

(a)            the address provided by you is either wrong or falls outside the delivery zone.

(b)           there is lack of information, direction or authorization from you at the time of delivery.

(c)            some or all the items ordered by you are unavailable at the time the order is being processed.

Customer Cancellation:

(a)           You can cancel your order for a product at no cost any time before We send the dispatch confirmation e-mail relating to that product confirming that the product has been dispatched for delivery. Unfortunately, an order cannot be cancelled once the item has been dispatched for delivery in which case you will have to return the items to Us after delivery by following Our Return Policy. Kindly refer to the return policy.

(b)           Upon cancellation, you will be notified of the same by email and refund about cancellation will be made in the following manner:

(i)            Electronic payment (credit card, debit card or net banking) refunds are processed within 2-4 business days whereby you will need to update following information to enable Us to process a refund to your account:

(ii)          Refunds to happen through the same mode by which the payment was made, however, you may want to request for a change to credit/ reward points.

(iii)        If your refund doesn’t appear in ‘Your Account’, and the processing time for your payment method has passed, contact Us for further assistance.

(e)           Expired Payment Method

If the original payment method you used to make the payment (credit/ debit card) is no longer valid, We will issue the refund through a demand draft.

When We receive a payment failure notice from your bank, We will send you an e-mail asking you to call us. When you call Us back, We will collect your name and the address where you want the demand draft to be sent, and proceed with the refund.

STEPS TO CANCEL

To cancel any order placed by you on Saveitbig App, first login with the same ID through which order is placed and after that customer can cancel the order. The order can be cancelled before delivery of the products only. Once the order is out for delivery customer cannot cancel the order through Saveitbig App. In case the customer wants to cancel the order at the time of delivery of products then the same can be mark as cancelled at the same time by the delivery associate.

INDEMNITY AND RELEASE

You shall indemnify and hold Us and Our officers, directors, agents and employees, harmless, from any claim or demand or actions including reasonable attorneys’ fees made by any third party or penalty imposed due to, or arising out of:

• your breach of these Terms or any document incorporated by reference, or your violation of any law, rules, regulations or third party rights; and
• any orders placed by you on the Site.

We will not be responsible for any indirect or consequential loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expense), that is not reasonably foreseeable to both you and Us when you commenced using the Site. Unless otherwise specified in these Terms, and subject to applicable laws, Our complete liability to You shall be limited to the refund the money received from You for the fulfilment of orders placed by you on the Website.

You hereby expressly release Saveitbig and/or its affiliates and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions/inactions of the vendors and specifically waiver any claims or demands that you may have in this behalf under any statute, contract or otherwise.

MODIFICATION

We may modify any of the terms and conditions contained in these Terms, without prior notice at any time and in Our sole discretion, by posting a change notice on the Site and your continued usage of the Site will be deemed to be your consent to the modified terms and conditions.

EVENTS BEYOND OUR REASONABLE CONTROL

We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is beyond our reasonable control.

Children

It is acknowledged and agreed that notwithstanding anything to the contrary, the Company shall not be liable, under any circumstances, whether in contract or in tort, for any indirect, special, consequential or incidental losses or damages, including on grounds of loss of profit, loss of reputation or loss of business opportunities.

TERMINATION

If you violate these Terms, or otherwise create risk or possible legal exposure for Us, We can stop providing you with access to all or any part of the Site. We may also delete or disable your account either temporarily or permanently at Our sole discretion and cancel any orders that have been placed by you.

GOVERNING LAW AND JURISDICTION

The seat of arbitration shall be Surat and the language of the arbitration shall be English.

Subject to the aforesaid, You agree, as We do, to submit to the exclusive jurisdiction of courts in Surat, India.
